Q: What are the steps in the divorce mediation process?
- Locate and contact a qualified divorce mediator:
Both parties should feel comfortable with the mediator and their abilities. Ask how many divorce mediation the mediator has performed.
- Initial meeting:
The mediator reviews the process with the couple and explains the basic concepts of mediation such as confidentiality and neutrality. We also establish ground rules and boundaries for all the parties.
- Frame the issues:
The mediator helps the couple express and understand each other’s goals and needs, identify key issues and establish the course to resolve them. The issues usually include the division of assets and debts, parenting schedules, child and spousal support and any other issues that are relevant to the couple’s particular situation.
- Information gathering and review:
The mediator guides the couple in gathering the appropriate information making certain that each spouse has a complete picture before making any decisions. Sometimes, an outside resource can be very helpful when additional expertise is needed. These professional include financial planners, CPA’s, therapists and appraisers and the mediator encourages the parties to consult with separate attorneys before signing any agreement.
- Negotiate the agreement:
The mediator facilitates discussions and brainstorming to move the couple towards a settlement by helping them develop various options to meet their needs and goals taking into account their similar goals yet balancing their differences.
- Written agreement:
Once the couple has reached an oral agreement, a written draft is prepared for their review and their attorney if needed.
